Original Text WHEREAS, Many of UC Berkeley’s NCAA Division I teams are currently housed in seismically unsafe Memorial Stadium; and

WHEREAS, The safety of students is of the utmost concern to the Associated Students of the University of California (ASUC); and

WHEREAS, The University of California plans to build the Student Athlete High Performance Center to safely house the athletic programs of 400 students; and

WHEREAS, The City of Berkeley, citing safety and environmental impact concerns, in conjunction with the California Oak Foundation, the Panoramic Hill Association and Save Tightwad Hill, has filed a lawsuit aimed at preventing construction of the Student Athlete High Performance Center; and

WHEREAS, The safety and environmental impact concerns cited in the lawsuit have been adequately addressed by extensive seismic studies and revisions by the University of California to its site and programming plans; and

WHEREAS, The Berkley City Council is meeting on September 11, 2007, to discuss its lawsuit and the possibility of settlement with the University of California; therefore, be it

RESOLVED, That the ASUC encourage the City of Berkeley to respect the safety of its student citizens by dropping or settling the lawsuit against the construction of the Student Athlete High Performance Center; and be it further

RESOLVED, That the ASUC expresses its support for the construction of the Student Athlete High Performance Center; and be it further

RESOLVED, That upon passage, the ASUC shall forward this resolution to the Berkeley City Council before its meeting on September 11, 2007.

Final Text WHEREAS, many of UC Berkeley’s NCAA Division I teams are currently housed in seismically unsafe Memorial Stadium; and

WHEREAS, the safety of students and University Staff is of the utmost concern to the Associated Stu¬dents of the University of California (ASUC); and

WHEREAS, the University of California plans to build the Student Athlete High Performance Center to safely house the athletic programs of 400 students as phase 1 of the California Memorial Stadium Campaign; and

WHEREAS, the City of Berkeley, citing safety and environmental impact concerns, in conjunction with the California Oak Foundation, the Panoramic Hill Association and Save Tightwad Hill, has filed a lawsuit aimed at preventing construction of the Student Athlete High Performance Center; and

WHEREAS, many of the safety and environmental impact concerns cited in the lawsuit have been adequately addressed by extensive seismic studies and revisions by the University of California to its site and programming plans; and


Whereas, the Berkley City Council met on September 4, 2007, and voted to reject a settlement offer from the University of California that addressed the aforementioned concerns

THEREFORE BE IT RESOLVED, that the ASUC encourage the City of Berkeley to respect the safety of its student citizens by settling the lawsuit against the construction of the Student Athlete High Performance Center as soon as possible.

Resolved, that the ASUC encourage the City of Berkeley to engage in dialogue with the University of California, regarding a possible settlement before the lawsuit goes back to court on September 19, 2007.

Resolved, that the ASUC President is assigned the following duty: Organize a discussion between the University, City of Berkeley, and other parties, to take place before September 19, 2007

Resolved, that the ASUC encourage the City of Berkeley to engage in dialogue with the University of California, regarding a settlement before the lawsuit goes back to court on September 19, 2007

BE IT FURTHER RESOLVED, that the ASUC expresses its support for the construction of the Student Athlete High Performance Center, phase 1 of the California Memorial Stadium Campaign.

BE IT FURTHER RESOLVED, that upon passage, the ASUC Secretariat shall immediately forward this Resolution to the Berkeley City Council and the Regents of the University of California
